Terms & Conditions

Welcome to Pitchwise. These Terms & Conditions (“Terms”) govern your access to and use of the Pitchwise app, website (pitchwise.uk), hardware products including the Mount, and related services (“Services”). By creating an account, downloading the app, or using the Services, you agree to be bound by these Terms.

Pitchwise is operated by Pitchwise Labs LTD, a company registered in England and Wales. If you have questions about these terms, contact us at info@pitchwise.uk.

1. Eligibility

• You must be at least 13 years old to use the Services
• Accounts for children under 13 years old require verified parental or guardian consent
• If you are under 18, you must have permission from a parent or guardian
• Accounts for teams, clubs, or leagues must be created by a person with authority to act on behalf of that organisation
• Teams and parents/guardians are responsible for ensuring minors’ rights are respected when using the Services

2. User responsibilities

• You must provide accurate and up-to-date information when registering an account
• You are responsible for maintaining the security of your account credentials and for all activity carried out under your account
• You must respect other users, teams, and the principles of fair play
• You agree not to share your login credentials with others
• You agree not to use the Services for any unlawful purpose or in any way that could damage, disable, or impair the Services

3. Content ownership and licences

You retain ownership of all content (e.g. videos, photos, comments) you upload to Pitchwise. By uploading content, you grant Pitchwise a worldwide, non-exclusive, royalty-free licence to host, store, process, display, and share it through the Services in line with your privacy settings.

You confirm that you have the necessary rights and permissions to upload and share any content you provide.

We may remove content that violates these Terms, our safeguarding policy, or applicable law, with or without notice.

4. Permissions and consent

• You agree only to upload content that you have the right to share, including obtaining consent from individuals who appear in the content (e.g. teammates, opponents, supporters)
• You agree not to upload or share personal information of others without their consent
• Submitting information (e.g. name, age, profile) on behalf of another team member requires their permission
• Publicly sharing information that was originally intended for private or group-only communications is not permitted

5. Prohibited uses

You must not use the Services to:

• Post unlawful, abusive, defamatory, or discriminatory content
• Share highly sensitive personal data of others without their consent
• Harass, bully, or impersonate others
• Attempt to hack, spam, or misuse the Services
• Copy, modify, reverse-engineer, decompile, or tamper with the Pitchwise app, platform, code, or hardware
• Use automated tools to scrape or extract data from the Services
• Use Pitchwise recordings in a way that violates the privacy or dignity of any person, particularly children

6. Moderation

• Pitchwise uses automated and human moderation to detect and remove harmful or inappropriate content
• Flagged content may be reviewed individually by our moderation team
• We reserve the right to suspend or remove any content or accounts that violate these Terms or our community guidelines

7. Hardware purchases

Pitchwise hardware, including the Mount, is sold through our online shop at shop.pitchwise.uk. All hardware purchases are subject to the checkout terms presented at the point of sale.

Under the Consumer Contracts Regulations 2013, you have the right to cancel a hardware order within 14 days of receiving the product, provided it is returned in its original condition and packaging. Faulty products are covered by your statutory consumer rights.

8. Subscriptions and pricing

Some features of Pitchwise require a paid subscription. Pricing, plan details, and billing frequency are displayed on our pricing page. We will notify existing subscribers of any changes to pricing with at least 30 days’ notice.

You may cancel your subscription at any time. Cancellation takes effect at the end of your current billing period. We do not offer refunds for partial billing periods.

9. Beta features

Pitchwise is in active development. Some features may be labelled as beta, early access, or coming soon. These features are provided as-is and may change or be removed without notice. We appreciate feedback on beta features but make no guarantees about their availability or timeline.

10. Third-party services

The Services may contain links to or integrations with third-party services (e.g. login providers, cloud storage, analytics, payment processors).

Pitchwise is not responsible for the content, policies, or practices of any third-party service. Your use of such services is subject to their own terms and privacy policies.

11. Intellectual property

Pitchwise owns all rights, title, and interest in the app, its design, branding, software, and underlying technology. You may not copy, reproduce, distribute, or create derivative works based on Pitchwise intellectual property without prior written consent, except as part of normal use of the service (e.g. sharing a clip that includes the Pitchwise watermark).

12. Limitation of liability

To the fullest extent permitted by law, the Services are provided on an “as is” and “as available” basis. We do not guarantee uninterrupted access, error-free performance, or that the Services will always be available. Pitchwise may update, suspend, or discontinue features of the Services at any time without liability.

Pitchwise shall not be liable for any indirect, incidental, or consequential damages, including but not limited to loss of data, loss of content, or reputational harm. Pitchwise is not liable for any user-generated content uploaded to the platform.

Nothing in these Terms limits or excludes our liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be excluded by law.

13. Indemnification

You agree to indemnify and hold harmless Pitchwise, its directors, employees, and partners from any claims, damages, or expenses arising from:

• Your misuse of the Services
• Your uploaded content
• Your violation of these Terms or the rights of any third party

14. Termination

• You may delete your account at any time through the app or by contacting info@pitchwise.uk
• Pitchwise may suspend or terminate your account if you violate these Terms or misuse the Services
• Upon termination, your right to use the Services will immediately end

15. Changes to these terms

We may update these Terms from time to time. If we make significant changes, we will notify you through the app or by email. Continued use of the Services after changes take effect constitutes acceptance of the updated Terms.

16. Governing law

These Terms are governed by and shall be construed in accordance with the laws of England and Wales. The courts of England and Wales shall have exclusive jurisdiction.
